By downloading, installing, or using the Dawn mobile application (the “App”) or any related services provided by Dawn App, Inc. (“Dawn,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
Dawn is a prayer alarm application. When an alarm sounds, the App uses your device’s microphone to listen as you recite a chosen prayer, and dismisses the alarm once the prayer has been recited the required number of times. The service is provided on an “as is” and “as available” basis.
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
Dawn does not require you to create an account. Your prayers, alarms, and preferences are stored locally on your device. You are responsible for maintaining access to your device and for any data stored within the App.

While we strive to make Dawn dependable, alarms depend on factors outside our control, including device settings, system permissions, background restrictions, battery level, and microphone availability. Dawn does not guarantee that an alarm will sound or that speech recognition will succeed in every environment. You should not rely on Dawn as your only alarm for time-critical obligations.
Dawn may include prayers and scripture drawn from public-domain and licensed sources across faith traditions. This content is provided for personal devotional use. Dawn is not affiliated with, and does not claim to represent, any particular denomination or religious authority.
The App, including its design, features, content, and underlying technology, is owned by Dawn App, Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works based on the App.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAWN APP, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Dawn App, Inc., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the App or violation of these Terms.
We may terminate or suspend your access to the App at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App will cease immediately.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the “Last updated” date. Your continued use of the App after changes constitutes acceptance of the revised Terms.
